1. Quotations
Diane Mannion Writing Services will supply a written quotation based on your project requirements. You are requested to sign and return the quotation document to indicate that you agree with the quotation before work can commence. If your accounts department require an order number to release payment, then you should enter this on the quotation form.
Quotations are normally provided free of charge. However, if we need to undertake certain tasks in order to provide a quotation these may incur a charge. These tasks may include, for example, where the word count is not specified, as with a website, and we need to total the word count manually to enable us to quote. In these circumstances we will advise you of the charge and the work involved and will provide a written quotation.
2. Additional Charges
In certain circumstances projects may incur an additional charge, as follows:
2.1. Revisions
Our copywriting charges include one revision provided this does not entail changing more than 25% of the overall document, and providing that we are notified of this revision within 7 days of delivery of the project. Any subsequent revisions will be charged at our normal hourly rate.
2.2. Changes in Project Scope
If, after agreeing our quotation, you notify us of any change to the scope or requirements of the project, we will issue a revised quotation to reflect this change. We will commence work according to the new requirements once we receive the signed revised quotation form. If agreement cannot be reached and you cancel the project, we will invoice you for the hours worked at our normal hourly rate. Alternatively, at your request we will continue the project according to the original instructions.
2.3. Subsequent Versions
If you require any subsequent versions of a document or web copy, these will be charged accordingly and we will issue a quotation form notifying you of these charges.
2.4. Redundant Material
If you do not use any of the material that we have produced at your request, the original charge will stand and you will not be entitled to a refund.
3. Advice
We will provide advice relating to projects based on our knowledge and experience. However, we do not accept responsibility for any action that you take as a result of any advice given by us.
4. Timescale
At your request we can quote an approximate timescale for projects and do our utmost to ensure that we adhere to any agreed timescale. However, if a deadline is missed due to unforeseen circumstances, we accept no responsibility for any losses incurred as a result.
Our record for meeting deadlines is exemplary and it is extremely rare that we fail to deliver on time.
4.1. Changes to Timescale
If you fail to let us have full details of your requirements to enable us to meet the agreed deadline, we cannot guarantee that the deadline will be met. Furthermore, we will have to reschedule the project for the next available date. This may result in further delays if we do not have immediate availability.
5. Payment Terms
Our normal payment terms are 7 days from date of invoice, which will be issued on completion of the project or at regular stages if agreed. In exceptional circumstances we will extend our payment terms up to a maximum of 30 days, for example, for larger customers that make regular scheduled payments. In these circumstances payment terms will be set out in accordance with a written agreement signed by you. In the event that you fail to meet these terms, we reserve the right to revert to our normal payment terms of 7 days.
5.1. Overdue Accounts
If you fail to make payments on time, we reserve the right to take further action to recover any overdue amounts. In the event that payments are still outstanding after the payment due date, we will give you 7 days written notice of our intention to take further action.
6. Copyright
On completion of copywriting projects, and on receipt of payment for the invoice relating to that project, copyright will pass to you. However, we reserve the right to quote and display the work in order to promote our business as detailed in section 7 of these Terms and Conditions.
7. Promotion
Although copyright passes to you on completion of projects, we reserve the right to refer to the work carried out on your behalf, in our promotional material, unless specifically forbidden to do so by you. This enables us to demonstrate our skills to interested third parties. This will be achieved using the following methods:
Displaying documents on our website
Inserting links from our website to any web copy or documents that we have written
Referring to you as a client in our promotional material including our website
Describing projects that we have carried out on your behalf
Displaying printed materials in our manual portfolio
Referring to any positive feedback received from you in relation to work carried out
N.B. At your request we will acknowledge your copyright in the abovementioned documents or websites.
8. Confidentiality
We will treat all material with the strictest confidence if requested to do so by you and are willing to sign a Non Disclosure Agreement if required.
9. SEO Work
We undertake many types of copywriting projects designed to improve website ranking. However, we do not give any guarantees that your website will achieve a higher rank as a result of the work we have completed. Website rankings are subject to continual change and also subject to many other factors beyond our control.
10. Cancellation
If you cancel a project after we have already started work on that project we will invoice you for the number of hours spent on that project at our normal hourly rate.
11. Disclaimer
Although we will do our utmost to ensure that any work produced by us is free of errors, inaccuracies, misrepresentations or omissions, the ultimate responsibility for publication remains with you. We therefore do not accept any liability for any losses, financial or otherwise, that may ensue as a result of any errors, inaccuracies, misrepresentations or omissions contained in any work produced by us, and published by you.
